\"\"Published <\/strong>regular<\/strong> issue<\/strong> legal scientific-theoretical quarterly <\/strong>\u201cJournal of the Kyiv University of Law,\u201d which was dedicated to the glorious anniversary \u2013 the 30th anniversary of the Kyiv University of Law of the National Academy of Sciences of Ukraine.<\/strong><\/p>\n

The journal contains 20 articles, including an introductory article, a journalistic article, and 18 scientific articles, 3 reviews, and a literature news overview.<\/p>\n

Published scientific studies address current issues in the theory and history of the state and law, philosophy of law, the legal system of Ukraine and international law, comparative law, administrative law and procedure, intellectual property law, civil, commercial, labor law and social security law in Ukraine, criminal law and criminology.<\/p>\n

In the introductory article “GENESIS AND INSTITUTIONAL DEVELOPMENT OF KYIV UNIVERSITY OF LAW OF THE NATIONAL ACADEMY OF SCIENCES OF UKRAINE: THIRTY-YEAR EXPERIENCE OF COMBINING ACADEMIC SCIENCE AND LEGAL EDUCATION <\/strong>(authors \u2013 Y.L. BOSHYTSKYI<\/strong><\/em>, Rector of KUL NASU, Prof., Professor of the Department of International and Private Law, Honored Lawyer of Ukraine and I.M. SOPILKO, <\/em><\/strong>Doctor of Law, Professor, Honored Lawyer of Ukraine, Advisor to the Rector of KUL NASU, a brief history of the founding of the university was presented, information was provided about the specifics of its institutional status, organization of the educational process, features of the teaching methodology, and the strategy of territorial expansion of academic standards to the regions of Ukraine: Rivne, Vinnytsia, Lviv, and Uzhhorod. It was noted that a significant achievement of KUL NASU over three decades was that the university transformed from a local capital institution into a powerful nationwide educational community, built a multi-level system of strategic partnerships abroad and in Ukraine, and demonstrated the ability to promptly reflect on socio-political and demographic challenges. The thirty-year foundation of the university is a reliable base for the further development of a legal state, where knowledge is not only a tool for career growth but also a guarantor of national security and justice.<\/p>\n

H.O. ANDROSHCHUK<\/em><\/strong>, Ph.D., Associate Professor, Senior Research Fellow at the Institute of Intellectual Property of the National Academy of Legal Sciences of Ukraine in the article “COP<\/strong>And<\/strong>RIGHT TRO<\/strong>LANGUAGE AS A TOOL OF UNFAIR COMPETITION: SIGNS AND METHODS OF COUNTERACTION<\/strong>\u00bb carried out economic–<\/strong>Legal analysis of the phenomenon of copyright trolling in the context of the digital economy as a tool of unfair competition. The researcher highlighted its specific features: blocking a competitor’s activities, depleting financial resources, reputational attacks; identified signs of unfair use of copyright: mass nature, absence of commercial use, concealment of authorship, offering quick settlements. Foreign court practice was analyzed, and mechanisms to counteract copyright trolling were developed.<\/p>\n

D.<\/strong>O.<\/strong>\u00a0<\/strong>BEZZUBOV<\/strong><\/em>, Doctor of Law, Professor, Academician of the National Academy of Higher Education of Ukraine, leading research fellow of the Department of State Administration and Administrative Law Problems at the V.M. Koretsky Institute of State and Law of the National Academy of Sciences of Ukraine, substantiated the conceptual transformation of the modern doctrine of administrative law of Ukraine under conditions of martial law, digitalization, and European integration processes in the article \u00abTHE PRINCIPLE OF THE RULE OF LAW IN MODERN ADMINISTRATIVE LAW DOCTRINE<\/strong>. The researcher proved that in wartime conditions, this paradigm naturally transforms into a socio-centric model, within which the interests of society and state stability become a necessary condition for the realization of individual rights and freedoms. On this basis, a benchmark for the new doctrine of administrative law was formulated as a concept of security rationality within the rule of law, which combines the humanistic nature of the field with the needs of defense, national security, and institutional stability. It was concluded that such a model is a strategic platform for the modernization of public administration in Ukraine.<\/p>\n

Ya.M. VAKULICH<\/strong><\/em>, Associate Professor of the Department of General Theoretical Legal and Socio-Humanitarian Disciplines, KUL NASU, in the article \u00abLEGAL LINGUISTICS AS AN INTERDISCIPLINARY SCIENTIFIC FIELD: STATE, TRENDS, AND PROSPECTS OF DEVELOPMENT <\/strong>She emphasized that legal linguistics is an interdisciplinary field that combines linguistics, law, psychology, and communicative studies, and examines language as a key tool of legal regulation. The modern state of the discipline is characterized by institutional development, the introduction of forensic linguistic expertise, analysis of hate speech, threats, manipulations, and text authorship. Current trends include the digitalization of legal communication, the use of artificial intelligence, the development of cognitive legal linguistics, and the implementation of plain language principles in law. According to the researcher, the prospects of the field are related to the standardization of terminology, the improvement of lawmaking, the creation of international standards for expertise, and the deepening of intercultural studies. of legal discourse.<\/p>\n

A.D. GULIYEV<\/strong><\/em>, Doctor of Juridical Sciences, professor, diplomat, honored worker of education of Ukraine, professor of the Department of Constitutional, International Law and Public-Law Disciplines of Kyiv University of Intellectual Property and Law, and V.V. CHEKALIUK<\/strong><\/em>, PhD, Cand. Sci. in Social Communications (Taras Shevchenko National University of Kyiv), in the article \u00abGASTRONOMIC DIPLOMACY IN FOREIGN POLICY: DIPLOMATIC MEETINGS AND STATE RECEPTIONS<\/strong> They conceptualized gastrodiplomacy and gastrocommunication as multifaceted, multivalent sociocultural phenomena that go far beyond satisfying basic physiological needs and function as effective tools of interpersonal, intercultural, and international communication. Based on the material of historical diplomatic meetings, state visits, and official receptions involving the President of the Azerbaijan Republic Heydar Aliyev (1993\u20132003), the researchers analyzed the role of gastrodiplomacy in shaping the international image of the state, creating an informal negotiation space, and enhancing the productivity of interstate dialogue. The authors examined the phenomenon of gastrodiplomacy in the context of global theories of “soft power” and intercultural communication, taking into account the historical continuity of culinary influence in diplomacy \u2013 from classical European traditions to modern state practices.<\/p>\n

A.K. SOLODKA<\/strong><\/em>, Doctor of Pedagogical Sciences, Professor of the Department of General Theoretical Legal and Socio-Humanitarian Disciplines at KUL NASU, Professor of the Department of Translation at the Admiral Makarov National University of Shipbuilding in the article \u00abREPRESENTATION OF THE LEGAL CONCEPT \u00ab<\/strong>PROBATION<\/strong>\u00bb IN ENGLISH LEGAL TERMINOLOGY\u00bb <\/strong>on the material of lexicographic sources, considered the representation of the legal concept probation<\/em> in English legal terminology, as well as defined the semantic scope and processes of semantic change of the word probation<\/em>, analyzed its connection with other words \u2013 representatives of the concept probation<\/em>The author presented a description of the semantics of the word for the first time probation<\/em> In the English language, in diachrony and synchrony, it revealed the features of verbalization of a legal concept designated by the term probation<\/em>. It was established that the main semantic content of the analyzed word historically was the process of testing, verification, which later became the basis during the formation of the legal concept probation<\/em>. It has been established that the term probation<\/em> contains additional elements of the content of a legal concept, while the concept itself reflects the main, essential features.<\/p>\n

L.O. KHOMENKO<\/strong><\/em>, PhD in Law, Associate Professor, Associate Professor of the Department of General Theoretical Legal and Socio-Humanitarian Disciplines, KUL NASU, the article \u00abGERMAN LANGUAGE AS A MEANS OF PUBLIC DIPLOMACY OF THE EUROPEAN UNION<\/strong>\u00bb devoted to the analysis of the role of the German language as an instrument of public diplomacy of the European Union and Germany, examined the activities of the Goethe-Institut, DAAD, Humboldt Foundation, and Deutsche Welle through the lens of language communication. This research is based on Joseph Nye’s concept of “soft power” and the analysis of German cultural policy. The focus is on shaping a positive image of Germany and the EU abroad, especially in the context of Ukraine’s European integration. It is argued that language is a central means of public diplomacy, and the German language serves as a tool for transmitting cultural values and promoting European standards. The practical significance lies in applying the experience of German public diplomacy to Ukraine.<\/p>\n

V.M. CHERNEHA<\/strong><\/em>, Doctor of Juridical Sciences, Professor, Acting Head of the Department of International and Private Law of KUL NASU, in the article \u00abUKRAINIAN GEOGRAPHY OF THE DEPARTMENT OF INTERNATIONAL LAW <\/strong>He investigated the network of departments of international law operating in higher education institutions in Ukraine. It was found that Kyiv has the largest number of departments of international law in higher education institutions of various forms of ownership. It was stated that KUL NASU is the only state-owned higher education institution in the NAS of Ukraine system that has been conducting long-term educational and scientific activities in the specialty ‘International Law.’ The scholar illustrated that some departments of international law operate in Vinnytsia, Dnipro, Ivano-Frankivsk, Irpin, Lviv, Odesa, Sumy, Ternopil, Uzhhorod, Kharkiv, Khmelnytskyi, and Chernivtsi.<\/p>\n

P.S. KATSAVETS<\/em>, <\/strong>PhD in Law, Associate Professor; Associate Professor of the Department of International and Private Law, KUL NASU, in the article \u00abLEGAL CULTURE: DESIRED RESULT <\/strong>it asserts that legal culture is connected with the general culture of the people and is based on established principles, reflecting the level of professional, intellectual, ethical, psychological, and language development in accordance with modern requirements. The system of values in the field of law that exists in the real functioning of society is called legal reality, since it is precisely this that structurally coincides with the concept of the ‘legal system.’ Legal culture is formed as a result of adherence to legal norms; assimilation of the system of values achieved by humanity in the legal field. Significant professional ethics, according to the researcher, is a set of specific moral norms along with common rules that serve certain spheres of human activity, the moral aspects of the interaction between an individual and of society.<\/p>\n

V.O. PAVLOV<\/strong><\/em>, Associate Professor of the Department of General Theoretical Legal and Socio-Humanitarian Disciplines, KUL NASU, in the article \u00abCONSTRUCTION OF THEMATIC GLOSSARIES AS A METHOD OF DEVELOPING A LAWYER’S PROFESSIONAL ENGLISH COMPETENCE <\/strong>proposed two approaches to creating thematic glossaries as one of the effective methods for mastering legal terminology in English \u2013 the frame-based and the functional-stylistic, which can be used separately or combined. It was indicated that the frame-based approach consists of four stages: motivation \u2013 assessment of possibilities \u2013 testing \u2013 engagement. The stages and significance of the frame-based approach to the formation of a terminological vocabulary and the application of flipped learning were clarified, and it was determined that it significantly individualizes and personalizes the educational process. It was studied that the functional-stylistic approach to compiling thematic dictionaries by future lawyers involves structuring vocabulary into thematic microfields with a clear distinction between core and periphery.<\/p>\n

A.V. PASHYNSKA<\/strong><\/em>, PhD in Law, Associate Professor of the Department of General Theoretical Legal and Socio-Humanitarian Disciplines at KUL NASU, in the article “THE PARADOX OF CONSERVATISM: RELIGIOUS MOVEMENTS IN THE TURKISH LEGAL SYSTEM <\/strong>XIX<\/strong>\u2013<\/strong>XX<\/strong> Art. <\/strong>She carried out a philosophical and legal analysis of the phenomenon of the ‘paradox of conservatism’ in the context of the development of the Turkish legal order during the 19th\u201320th centuries. Using the example of three religious movements: the Khalidis, the Nurists, and the G\u00fclen community, she revealed how an appeal to tradition can serve as a source of normative innovations. The researcher paid special attention to the formation of alternative legitimacy that arises outside state institutions through moral discipline, educational structures, texts, and network self-organization. According to the author, combining the historical context with a philosophical and legal approach allows one to rethink the understanding of sources of law and the role of religious communities in the transformation of the legal order.<\/p>\n

I.V. SERVETSKYI<\/strong><\/em>, Doctor of Juridical Sciences, Associate Professor, Professor of the Department of Criminal Law and Procedure at KUL NASU, and M.Yu. LITVIN<\/strong><\/em>, graduate student of KUL NASU in the article \u00abHistory AND contemporary problems of fighting corruption in Ukraine <\/strong>The activities of government and administrative bodies in Ukraine were studied diachronically. Various approaches to defining corruption were analyzed, a classification of acts of corruption was proposed, and the economic causes of its growth were summarized. It was established that combating corruption in Ukraine has a long historical path, accompanied by the activities of anti-corruption bodies (NACP, NABU, ARMA, Specialized Anti-Corruption Prosecutor’s Office; High Anti-Corruption Court), the adoption of a number of laws, which formed the anti-corruption system in Ukraine and made it possible to significantly improve the situation in the field of combating corruption. Researchers concluded that anti-corruption policy at the local level should rely on public self-government, while government and administrative bodies should occupy a central place. and specially created law enforcement agencies.<\/p>\n

R.V. PERELYGINA, <\/em><\/strong>Assoc. Prof. of the Department of Criminal Law and Procedure at KUL NASU, PhD in Law, Assoc. Prof. M.I. SMIRNOV, <\/em><\/strong>PhD in Law, Associate Professor, Associate Professor of the Department of Criminal Procedure of the National University “Odessa Law Academy”, in the article “HARMONIZATION OF THE CRIMINAL PROCEDURAL LEGISLATION OF UKRAINE WITH THE PROVISIONS OF THE ROME STATUTE OF THE INTERNATIONAL CRIMINAL COURT IN TERMS OF ARREST AND TRANSFER OF A PERSON <\/strong>They investigated the procedure for executing a request for arrest and transfer of a person and the actual transfer to the International Criminal Court. The authors identified a number of regulatory conflicts and legal gaps that may significantly limit the effectiveness of Ukraine’s interaction with the International Criminal Court regarding the execution of a request for arrest and transfer of a person.<\/p>\n

S.S. POROSKUN<\/strong><\/em>, Doctor of Philosophy (Sumy National Agrarian University), asserts that the relevance of the article \u00abAdministrative procedures in the context of digitalization: balance between managerial efficiency and legal certainty <\/strong>caused by the need to find an optimal balance between the technologization of administrative processes and the observance of fundamental human rights standards enshrined in the Law of Ukraine “On Administrative Procedure.” The author analyzed the role of digitalization as a catalyst for managerial efficiency, determining that the automation of routine operations, the implementation of electronic interaction systems, and the realization of the “once only” principle make it possible to minimize time costs and mitigate corruption risks. The scientific novelty of the study lies in the development of conceptual approaches to challenging automated decisions.<\/p>\n

In the ‘Guest of the Issue’ section, information is provided about a significant event \u2013 the visit of the Speaker of the Seimas of the Republic of Lithuania, Mr. YUOZASA OLEKASA<\/strong><\/em> to the Kyiv University of Law of the National Academy of Sciences of Ukraine. The Speaker of the Seimas of the Republic of Lithuania visited the university with a guest lecture for higher education students and the academic staff of KUL NASU. The distinguished guest also took part in an extended meeting of the Academic Council, during which he was ceremoniously awarded an honorary title\u00a0Doctor<\/strong> Honoris<\/strong> Causa<\/strong>\u00a0Kyiv University of Law of the National Academy of Sciences of Ukraine.<\/p>\n
