The issues of regulating the creation, protection, and use of intellectual property objects, the distribution of IP rights in contracts for the performance of scientific research and development and contracts for cooperation in conducting scientific research (R&D contracts) between scientific institutions and enterprises, state authorities, international organizations and funds, foreign institutions, and organizations have been considered.

The legislation and practice of regulating intellectual property relations in R&D contracts of various countries have been analyzed. Proposals for bringing legislative regulation and the practice of concluding R&D contracts in Ukraine closer, as well as regulating intellectual property relations in contracts, in line with European Union practice, have been substantiated.

The textbook has been prepared in accordance with the educational component programs ‘Intellectual Property Law’ and ‘Copyright and Related Rights’ based on the provisions of the current positive law in this field, taking into account the requirements for knowledge, skills, and competencies of specialists, the evaluation criteria of the Bologna system, the experience of regulating these relations in other countries, modern theoretical constructions of individual institutions, judicial practice, and the accumulated experience of teaching this academic discipline for various specialties.

It contains analytical reviews of published theoretical constructions of legal institutions and sub-institutions, including the authors’ own views on resolving bottlenecks in law-making and law enforcement. It can be used in conducting further scientific research on the legal regulation of intellectual property relations. It differs in its structure from other similar publications and presents the material with a plan, the main acts of civil legislation divided into international and national, additional classical and contemporary literature, issues of the plan explained, and at the end, questions for self-assessment are provided, taking into account typical tasks for final test control.

The most typical types of legitimate interests with their own methods of protection have been identified. The legislative basis for the judicial protection of rights and legitimate interests in the analyzed field has been studied and specified.
