The first issue of 2025 of the legal scientific-theoretical quarterly ‘Journal of Kyiv University of Law’ has been published

One of the landmark events in the scientific legal sphere of Ukraine in 2025 was the publication of the first issue of the “Kyiv University of Law Journal,” which represented the continuity of a long-standing tradition of informing about current trends in the development of law and its latest achievements.

A distinctive feature of this edition is that it was mostly formed by scientific studies of authoritative Ukrainian legal scholars, known both in Ukraine and beyond; a smaller portion consists of articles by young scholars – graduate students and postgraduates.

The “Kyiv University of Law Journal” is composed of an introductory article, 25 scholarly articles (including 1 in English), written both individually and in collaboration, as well as an article about the activities of the Scientific Library of KUL NASU.

The materials of the publication are designed for current issues in the theory and history of the state and law, philosophy of law, constitutional, administrative, financial, informational, commercial, agrarian, land, environmental, criminal, civil, labor, and international law, social security law in Ukraine, and intellectual property rights.

In the introductory article “Cultural and Artistic Practices in the Educational Space of a Law University: Training a Specialist in the Conditions of Societal Transformations and War” Yuriy Ladyslavovych Boshytskyi, Rector of KUL NASU, professor, honored lawyer of Ukraine, and Iryna Mykolaivna Sopilko, Doctor of Juridical Sciences, Professor, Honored Lawyer of Ukraine, Advisor to the Rector of KUL NASU focused their attention on the fact that education as a social institution is not only a source of knowledge but also a mechanism of cultural transmission, which contributes to the formation of a holistic, socially responsible personality. The authors emphasized that the formation of a personal educational trajectory of a future lawyer is impossible without taking into account the cultural and aesthetic components, which shape a set of value guidelines that determine a person’s inner motivation for self-realization in the professional legal field.

Famous Ukrainian historian, politician Dmytro Vasylovych Chobit in continuation of his thorough research “On Statehood in the Ancient Ukrainian Lands (continued)” He described in detail the fortifications of the 10th–5th centuries BCE in the interfluve of the Dniester and the Dnieper, which became a silent testimony of ancient Ukrainian statehood, while at the same time refuting the pseudo-theories of the Soviet era regarding the past of Ukraine.

Vice-Rector for Research at KUL NASU, Doctor of Juridical Science, Professor of the Department of Criminal Law and Procedure Ivan Yuriyovych Kaylo in the article «Remote work as a special form of labor organization under martial law He investigated the features of legal regulation and practical implementation of remote work under martial law in Ukraine, analyzed the regulatory and legal framework governing remote work.

Volodymyr Oleksandrovych Pavlov, Senior lecturer of the Department of General Theoretical Legal and Socio-Humanitarian Disciplines, KUL NASU, in the article “Integration of a foreign language into the professional training of a lawyer: international experience” considered the integration of foreign languages into the professional training of lawyers based on international experience, in particular in countries with developed legal systems: France, Great Britain, the USA, China, and Japan; emphasized the importance of knowledge of foreign languages.

Anzhelika Kostyantinivna Sweet, Doctor of Pedagogical Sciences, Professor of the Department of General Theoretical Legal and Socio-Humanitarian Disciplines at KUL NASU, Professor of the Department of Translation at the Admiral Makarov National University of Shipbuilding, in the article “The Use of Anglicisms by Subjects of Legal Activity” researched English legal terms, identified the main reasons for the emergence of Anglicisms in legal language, and classified them.

Natalia Anatoliivna Sura, Doctor of Pedagogical Sciences, Professor, Head of the Department of General Theoretical Legal and Socio-Humanitarian Disciplines at KUL NASU, characterized the modern educational paradigm as an indicator of changes in higher professional education aimed at improving the professional foreign language training of future lawyers in the context of innovative learning tools, models, and technologies in the article Enhancing the professional foreign language training of future lawyers in the context of higher professional education.

Olena Mykolaivna Romanova, PhD in Law, Associate Professor of the Department of General Theoretical Legal and Socio-Humanitarian Disciplines of KUL NASU, in a scientific study Legal regulation of the educational process in Ukraine» She researched issues related to the implementation of the right to education during wartime; determined that Ukraine became the target of aggression, operations, and wars, and its educational sphere came under threat; analyzed the laws that were adopted during military actions on the territory of our state; provided existing approaches to the legal regulation of educational processes across the entire territory of Ukraine.

Valeriy Ivanovych Dyachenko, PhD in Law, Associate Professor of the Department of Constitutional, International Law and Public Law Disciplines at the Kyiv University of Intellectual Property and Law of the National University “Odesa Law Academy”, in the article «The ecological aspect of the humanitarian crisis in the context of contemporary international humanitarian law» analyzed the effectiveness of the international legal protection of the environment from the destructive effects of armed conflicts; paid attention to the objective and subjective factors weakening the effectiveness of international legal environmental norms; attempted to find effective mechanisms of international legal protection of the environment from the threatening consequences of military actions.

Svitlana Yaroslavivna Fursa, Doctor of Juridical Science, Professor, Professor of the Department of International Law and Sectoral Legal Disciplines at KUL NASU, Honored Lawyer of Ukraine and Yevhen Ivanovych Fursa, PhD in Law, Professor, Professor of the Department of International Law and Sectoral Legal Disciplines at KUL NASU in the article “Preparatory Proceedings in Civil Procedure: Theory and Problems of Legislative Regulation” They studied the legal nature of preparatory proceedings in civil procedure and provided a critical analysis of judicial practice in the implementation of the norms of the CCP of Ukraine.

Viktoriya Valentynivna Nadion, Doctor of Juridical Science, Professor, Professor of the Department of Civil Law Policy, Intellectual Property Law and Innovation at Yaroslav Mudryi National Law University in the article «Legal regime of marital property under the legislation of Ukraine and some other countries» analyzed the legal regime of marital property in our country in a comparative aspect with the legislation of other countries of the world.

Ivan Ivanovych Vashchynets, PhD in Law, Associate Professor, Acting Head of the Department of International Law and Sectoral Legal Disciplines at KUL NASU, article «The purpose of compensation for damages in contractual obligations» dedicated to the analysis of views on the purpose of compensation for damage caused by breach of contractual obligations in Ukrainian and foreign civil law.

Veronika Vasylivna Chekaliuk, Ph.D. in social communications, investment attraction specialist, PR-technologist (Kyiv, Ukraine), researcher at Taras Shevchenko National University of Kyiv, conducted an in-depth interdisciplinary analysis of the transformation of Ukraine’s state image in conditions of global information turbulence, increased digital interaction, and post-crisis recovery in the article «State imageology as a strategic tool of political and legal marketing of Ukraine in the conditions of global transformation».

Volodymyr Oleksiyovych Hrynyuk, Doctor of Law, Professor, Professor of the Department of Criminal Procedure and Criminalistics of the Educational and Scientific Institute of Law of Taras Shevchenko National University of Kyiv, his article «Temporal limits of property seizure in criminal proceedings» dedicated to the seizure of property in the context of determining the temporal limits of its action – a measure ensuring criminal proceedings that restricts property rights.

Ivan Vasylovych Servetskyi, Doctor of Juridical Science, Associate Professor, Professor of the Department of Criminal Law and Procedure at KUL NAS of Ukraine, in the article «Interdependence of general legal and professional principles of advocacy» Based on the analysis of scientific and regulatory-legal sources, he outlined the system of principles of advocacy and concluded that they closely interact with each other.

In the article «The transformation of cybercrime: involving women and children as a trend of 2025» Alla Yuriyivna Kovalchuk, Doctor of Juridical Science, Professor, Professor of the Department of International Law and Other Branch Legal Disciplines, Kyiv University of Law of the National Academy of Sciences of Ukraine; Iryna Volodymyrivna Nakonechna, Doctor of Juridical Sciences, Associate Professor, Professor of the Department of General Legal Disciplines of the National Academy of the Security Service of Ukraine; Vladyslav Danylovych Havlovskyi, PhD in Law, Senior Research Fellow, Chief Research Fellow of the Interdepartmental Research Center on Combating Organized Crime under the National Security and Defense Council of Ukraine, analyzed statistical indicators for the first quarter of 2025 compared to the previous year, reflecting the state and structure of cybercrime in Ukraine. The researchers identified the main trends in the changes of cybercrime and emphasized the need for organizational and legal measures to counter it.

Oleksandr Vasylovych Batanov, Doctor of Juridical Science, Professor, Honored Worker of Science and Technology of Ukraine, Leading Researcher of the Department of Constitutional Law and Local Self-Government of the V.M. Koretsky Institute of State and Law of the National Academy of Sciences of Ukraine, in the article «Conceptual problems of implementing the right to freedom of movement and free choice of residence in the municipal-legal aspect» investigated the municipal-legal provision of the rights to freedom of movement and free choice of place of residence in Ukraine; analyzed doctrinal and normative sources of these rights, revealed the content of certain historical stages of the formation and development of the rights to freedom of movement and free choice of place of residence.

Olesya Mykolaivna Kyrylenko, Doctor of Law, Associate Professor, Head of the Department of General Theoretical Legal and Humanitarian Disciplines of the Rivne Institute of KUL NASU, [his/her] article «Features of the activities of local authorities in Ukraine in the implementation of sustainable development goals in the context of military challenges» dedicated to the topic of public administration and the issue of political, legal, social, and environmental research – the role of local authorities in ensuring the sustainable development of Ukraine at the level of territorial communities in the context of military challenges.

Significant scientific achievements represent articles of young researchers (postgraduates) in articles, performed in collaboration with scientific supervisors.

 In the article «State and problems of legal regulation of advertising activity in Ukraine» Yuriy Ladyslavovych Boshytskyi, Rector of KUL NASU, Prof., Honored Lawyer of Ukraine, and Asp. Zinaida Ivanivna Furrier they proposed a thorough study of the legal provision of the advertising sphere in Ukraine and the countries of the European Union, emphasizing legislative and structural-organizational aspects with the aim of adapting progressive European experience.

Maria Vasylivna Mendzhul, Doctor of Juridical Science, Professor, Professor of the Department of Civil Law and Procedure of the State Higher Education Institution “Uzhhorod National University” and Vladyslav Serhiyovych Andrus, PhD student of the Department of Civil Law and Procedure of the State Higher Educational Institution ‘Uzhhorod National University’ in the article «Forms of placement of children without parental care in Ukraine and EU countries: a comparative analysis» presented the results of a comparative study of forms of placement of children without parental care in Ukraine, EU member states, and the United Kingdom.

Raisa Volodymyrivna Perelyhina, PhD in Law, Associate Professor, Associate Professor of the Department of Criminal Law and Procedure at KUL NASU and PhD student Stanislav Mykolayovych Furrier in the article «Ofeatures of the criminal-legal qualification of violations of the laws and customs of war» the articles revealed the general provisions of the crime provided for in Art. 438 of the Criminal Code of Ukraine, namely: the nature of the description of the disposition of this article; forms of the objective side of the violation of the laws and customs of war; the content of violations of international humanitarian law norms; means of committing the crime.

Nadiya Ludvigivna Drozdovych, PhD in Law, Associate Professor of the Department of Criminal Law and Procedure at KUL NASU and applicant Oleksiy Viktorovych Chervinskyi article Comparative Analysis of Prosecution for Committing Domestic Violence in Peacetime and During Martial Law dedicated to the analysis of trends in domestic violence during peacetime and martial law in Ukraine.

Author sections ‘Guest of the Issue’ became Hennadiy Oleksandrovych Androshchuk, PhD in Engineering, Associate Professor, Chief Scientific Officer at the Institute of Intellectual Property of the National Academy of Legal Sciences of Ukraine, who in the article “Combating Unfair Trademark Registration in the EU: Tools and Practices of EUIPO” He proposed an examination of the content of two recent practices of the European Union Intellectual Property Office (EUIPO): CP13 – regarding trademarks registered in bad faith, and CP14 – regarding trademarks that are contrary to public policy or accepted principles of morality, and the tools for their application.

They also shared their scientific achievements postgraduate students and applicants, in particular Hlushchenko O.O.. ‘Development of a model for transforming the functions of the modern state under martial law,’ Kushnir Z.I. “Legal Aspects of Advertising Elements”, Vyshnevskyi V.O.. “The necessity of improving the legislation of Ukraine in the field of personal data protection” Baghirov S. «A laconic analysis of the universality of human rights from the Quranic perspective: is it really 1300 years ahead?».

The head of the KUL NASU Scientific Library informed about the library’s activities in modern conditions Yaroshevska T.Yu. in the article University Library and the Challenges of the Information Society.
