The III issue of 2025 of the legal scientific-theoretical quarterly ‘Journal of Kyiv University of Law’ has been published

The 3rd issue of the 2025 legal scientific-theoretical quarterly has been published Kyiv University of Law Magazine, which was dedicated to the glorious anniversary – the 30th anniversary of the Kyiv University of Law of the National Academy of Sciences of Ukraine.

The ‘Kyiv University of Law Journal’ is composed of 20 articles, including an introductory scientific article, 19 scientific articles, 4 reviews, and a review of new literature.

The represented articles address current issues in the theory and history of state and law, philosophy of law, the legal system of Ukraine and international law, comparative jurisprudence, administrative law and procedure, financial law, intellectual property law, civil, commercial, labor law and social security law in Ukraine, criminal law and criminology.

In the introductory article «Development of the KUL NASU branch in Zakarpattia BOSHYTSKYI Y.L., Rector of KUL NASU, professor, Honored Lawyer of Ukraine, Ambassador of Peace and VASHCHYNETS I.I., PhD in Law, Associate Professor, Associate Professor of the Department of International Law and Sectoral Legal Disciplines at KUL NASU, informed about the functioning and role of one of the separate structural units of the Kyiv University of Law of the National Academy of Sciences of Ukraine – the Scientific and Advisory Center in Uzhhorod, headed by Associate Professor Ivan Vashchynets. The authors emphasized that this important structural unit has been serving as the university’s representative in the territory of the Zakarpattia region for over ten years, contributing to the development of the institution’s educational, scientific, and research activities in the region, which enhances the university’s authority and influence beyond the capital.

SOLODKA A.K., Doctor of Pedagogical Sciences, Professor of the Department of General Theoretical Legal and Socio-Humanitarian Disciplines at KUL NASU, Professor of the Department of Translation at the Admiral Makarov National University of Shipbuilding, in the article «The role of the language of law in the dialogue of cultures analyzed the essence of conceptual changes in legal English. The basis of her research consists of empirical, theoretical, and linguistic methods, which make it possible to study the problem comprehensively and solve the tasks set. The research material included speech styles, legal texts and documents, legal terms, and other linguistic units.

ROMANOVA O.M., PhD in Law, Associate Professor of the Department of General Theoretical Legal and Socio-Humanitarian Disciplines at KUL NASU, in the article «Online platforms as components of obtaining modern higher education in Ukraine She studied the role of online platforms as integral components of higher education in Ukraine, revealed the essence and specifics of the use of digital educational environments, and analyzed their impact on the quality, accessibility, and innovativeness of educational services.

PAVLOV V.O., senior lecturer of the Department of General Theoretical Legal and Socio-Humanitarian Disciplines, KUL NASU, in the article «Oral translation from English legal language during a court trial analyzed the features of oral translation of English legal language during the court process, examined the specifics of the professional environment, the difficulties associated with conveying legal concepts in another language, as well as the role of the translator as an intermediary between participants in the judicial process. The researcher concluded that high-quality translation is a key factor in the effective administration of justice.

BORODIN K.S., Master of Technical Sciences, Master of Law, lecturer at the Department of General Theoretical Legal and Socio-Humanitarian Disciplines of KUL NASU, in the article «Regulation of artificial intelligence in Ukraine: adaptation to EU standards in the context of European integration» He emphasized that the development of artificial intelligence creates new opportunities for the economy and public administration, but at the same time presents society with a number of ethical and legal challenges. The author analyzed the key provisions of the EU AI Regulation (AI Act) and their significance for the process of adapting Ukrainian legislation, concluding that for effective European integration, Ukraine needs to develop an AI law that would take into account the principles of transparency, non-discrimination, and explainability enshrined in the AI Act.

POLUNINA L.V., Ph.D. in Law, Associate Professor, Professor of the Department of Legal Support and Law Enforcement Activities of the Kyiv Institute of the National Guard of Ukraine, Associate Professor Department of International and Private Law of KUL NASU in the article «The issue of liability for environmental crimes in international law» She proposed an analysis of the legal regulation of liability for environmental crimes in international law. The researcher examined key international normative acts that define the concept and classification of environmental crimes, mechanisms of holding accountable, as well as challenges associated with their implementation.

SYVYTSKYI V.S., lecturer of the Department of Special Legal Disciplines of RI KUL NASU, in the article “Features of Ensuring Environmental Safety in Ukraine under Martial Law” he justified the need to update the basic Law ‘On Environmental Protection’, proposed introducing new provisions on documenting damage, renewing state control, strengthening responsibility for war-related environmental crimes in international law, and initiating the recognition of ecocide.

BEZZUBOV D.O., Doctor of Juridical Science, Professor, Academician of the National Academy of Sciences of Higher Education of Ukraine, Professor of the Department of International Law and Sectoral Legal Disciplines at KUL NASU, Leading Researcher at the Department of State Administration and Administrative Law Problems of the V.M. Koretsky Institute of State and Law of the National Academy of Sciences of Ukraine, in the article Administrative Law in the Conditions of Statehood Transformation: From Normativism to Sociocentrism studied the evolution of administrative law in Ukraine from the normativist paradigm, focused on the formal consolidation of the powers of government bodies, to the human-centered doctrine, which places human rights and freedoms and democratic procedures at the center.

FURSA S.Y., Doctor of Juridical Science, Professor, Professor of the Department of International Law and Sectoral Legal Disciplines at KUL NASU, Honored Lawyer of Ukraine, FURSA Y.I., PhD in Law, Professor, Professor of the Department of International Law and Sectoral Legal Disciplines at KUL NASU in research «Analysis of the Specific Features of Types of Civil Proceedings and Their Subject Composition: Current Issues of Theory and Practice» The analysis of the theory and judicial practice of the specific features and subject composition of such types of civil proceedings as claim (simplified and general), order, and special proceedings is presented. The authors revealed their essence, subject composition, and expressed their vision regarding the correct application of the conceptual framework both in these types of proceedings and in the entire civil process in particular, and proposed amendments to the civil procedural legislation in order to harmonize these types of proceedings and systematize them in a single general provision, etc.

PEKAR A.O., Ph.D. in Law, lecturer at the Department of International Law and Sectoral Legal Disciplines of KUL NASU, in the article Problematic issues of the practical application of the institute amicus curiae in commercial litigation in Ukraine analyzed the amicus curiae institute in the commercial process of Ukraine, in particular its genesis, development in foreign legal systems, application in international judicial institutions.

VASHCHINEC I.I., PhD in Law, Associate Professor, Associate Professor of the Department of International Law and Branch Legal Disciplines at KUL NASU, article Legislative restrictions on the author’s personal non-property rights in cases of free use of works devoted to the study of the issues of limiting the personal non-property rights of the author in cases of free use of works provided for by the new Law of Ukraine “On Copyright and Related Rights.” The scholar substantiated that the right of authorship and the right to the integrity of the work are human rights and points out the inconsistencies of the provisions of the mentioned law regarding cases of free use without indicating the author’s name with the requirements of legislation, as well as with European legal standards, since the narrowing of the right of authorship envisaged by them does not correspond to its non-property nature and the principle of inadmissibility of narrowing the content and scope of human rights.

PONOMARENKO M.V., lecturer of the Department of International Law and Sectoral Legal Disciplines at KUL NASU, lawyer, Doctor of Philosophy in the field of law, CEO of the Educational Online Platform «Pravozno», in the article ‘Transformation of Corporate Governance in Ukraine after the Abolition of the Commercial Code’ considered the transformation of corporate governance in Ukraine in connection with the abolition of the Commercial Code of Ukraine from August 28, 2025.

SERVETSKYI I.V., Doctor of Law, Associate Professor, Professor of the Department of Criminal Law and Procedure at KUL NASU and LITVIN M.YU., graduate student of KUL NASU in the article Legal principles of ensuring the rights and freedoms of the individual They studied the key legislative acts of Ukraine that form the system of guarantees for the protection of the rights and freedoms of individuals and citizens, as well as the mechanisms for their implementation and protection. The authors demonstrated that ensuring human rights and freedoms in Ukraine requires a systematic approach, the combination of national and international standards, and the strengthening of mechanisms for monitoring compliance with the law.

The guest of the issue was HAMOR F.D., Doctor of Biological Sciences, Professor, Honored Conservationist of Ukraine, Deputy Director for Scientific Work of the Carpathian Biosphere Reserve (Rakhiv, Zakarpattia Oblast), “Legal issues of preservation of the nature reserve fund of Ukraine and recommendations for their regulation”, who analyzed the state of the nature reserve fund of Ukraine, in particular the Carpathian Biosphere Reserve, presented a quantitative characteristic of the territories and objects of the nature reserve fund of Ukraine according to the data of the State Cadastre. The author emphasized the problems of preservation and development of the nature reserve fund, the necessity of addressing the issues of financing and material-technical support of fund institutions, as well as the creation of new reserves and national natural parks, etc.; analyzed regulatory legal acts in the field of protection and development of the nature reserve fund.

Young researchers also shared their own scientific research: graduate students, bachelor’s and master’s degree candidates.

SOKALIUK V.D., PhD student at KUL NASU on the topic Institutions of the European Union’s Monetary Policy, dedicated his article to the study of the institutions that carry out the European Union’s monetary policy. VYSHNEVSKYI V.O., PhD student of KUL NASU in the article «Transformation of law sui generis under the influence of the Data Act submitted an analysis of the fundamental impact of Regulation (EU) 2023/2854 (Data Act) on sui generis database rights. KUSHNIR Z.I., PhD student of KUL NASU in the article “Legal Regulation of Advertising Activities: Experience of Ukraine and European Union Countries” researched the legal regulation of advertising activities in Ukraine and the countries of the European Union. PETRUSHIN B.B., PhD student of KUL NASU in the article «Challenges to Intellectual Property Law in the Digital Economy» focused attention on the current challenges to intellectual property law in the digital economy. DUDINOV I.V., a postgraduate student of the Department of Agricultural and Land, Environmental and Space Law of the V.M. Koretsky Institute of State and Law of the National Academy of Sciences of Ukraine, in the article «Legal regulation of the use of artificial intelligence in environmental management in Ukraine investigated the current state of legal regulation of the use of artificial intelligence (AI) in natural resource management in Ukraine.

NOVIKOVA V.O.., a KUL NASU applicant, proposed a scientific study “Interrogation of minors or underage persons in criminal proceedings”, which was devoted to the study of certain aspects of the interrogation of young children and minors in criminal proceedings in the capacity of a victim or witness and in the capacity of a suspect or accused, taking into account age and personal characteristics.
