The second issue of the 2025 legal scientific-theoretical quarterly ‘Journal of Kyiv University of Law’ has been published

We are pleased to inform you that the 2nd issue of 2025 of the legal scientific-theoretical quarterly “Kiev University of Law Journal” has recently been published, which traditionally represents the continuity of a long-standing tradition of informing about modern trends in the development of law and its latest achievements.

This issue was dedicated to the bright memory of the professor Rainer Arnold – a world-recognized German scientist, a highly qualified legal scholar who devotedly served his people, the global legal community, and the science of constitutional law.

The materials of the publication address current issues of the theory and history of the state and law, philosophy of law, the legal system of Ukraine and international law, administrative, financial, civil, commercial, labor, criminal law and social security law in Ukraine, intellectual property law.

The “Kyiv University of Law Journal” is composed of 39 articles, including an introductory scientific article, 23 scientific articles, 16 memorials, 2 reviews, and a review of new literature.

Yuriy Ladyslavovych Boshytskyi, Rector of KUL NASU, professor, honored lawyer of Ukraine, vice president of the World Congress of Ukrainian Lawyers, and Violetta Valentynivna Ulishchenko, Doctor of Pedagogical Sciences, Professor, Vice-Rector for Educational and Methodological Work, in the introductory article “Legal education of the future: forming identity through immersive experience» analyzed the impact of immersive technologies (VR/AR) on the formation of professional identity of future lawyers, justified the relevance of the transition from the traditional model of legal education to an interactive simulation paradigm. The results of a pilot study of VR debates in the format of the Student Parliament of KUL NASU were presented, which revealed an increase in students’ argumentative ability, ethical sensitivity, and communicative confidence; ethical dilemmas of implementing VR in judicial practice were highlighted.

Article “The Functioning of Lexical Units in the Structure of a Legal Text (Based on the English Language)” Anzhelika Kostyantinivna Solodka, D.Sc. (Law), professor of the Department of General Theoretical Legal and Socio-Humanitarian Disciplines at KUL NASU, professor of the Department of Translation at the Admiral Makarov National University of Shipbuilding, devoted to the study of lexical units in legal text as the main communicative unit in legal discourse.

In the article “Formation of a Sustainable Higher Education Model in Conditions of Armed Conflict” Elena Nikolaevna Romanova, PhD, Associate Professor of the Department of General Theoretical Legal and Socio-Humanitarian Disciplines at KUL NASU, examined the key challenges in the higher education system of Ukraine under conditions of full-scale war and outlined the strategic directions for the transformation of the higher education system.

Article “Gender Stereotypes and Key Aspects of the ‘Women’s Issue’ in the Spheres of Protecting State Interests” Viktoriya Viktorivna Pylypenko, PhD in Law, Associate Professor, Associate Professor of the Department of Theory, History, and Philosophy of Law at NNIIPP of the NAPA; Associate Professor of the Department of General Theoretical Legal and Socio-Humanitarian Disciplines at KUL NASU, devoted to the implementation of gender equality in the context of Russia’s full-scale invasion of the territory of Ukraine: both at the general societal level and at the level of law enforcement and defense activities.

Yuriy Vitaliyovych Kryvytskyi, PhD in Law, Associate Professor, Associate Professor of the Department of Theory, History and Philosophy of Law of the National Academy of Internal Affairs, in intelligence «Research Approaches to Understanding Legal Reform: Searching for Common Points of Contact and Intersection» expanded and deepened theoretical understandings of the essence of legal reform through the awareness of contradictions between knowledge and legal life or contradictions within legal knowledge itself.

Maria Mykhailivna Huchko, Doctor of Public Administration, Associate Professor of the Department of International Law and Sectoral Legal Disciplines at KUL NASU, investigated the problem of labor exploitation in contemporary Ukraine, analyzed the legal mechanisms for detecting, preventing, and responding to cases of labor exploitation based on Ukrainian legislation in the article “Legal Mechanisms for the Protection of Persons Affected by Labor Exploitation”.

Dmytro Oleksandrovych Bezzubov, Doctor of Law, Professor, Head of the Department of International Law and Sectoral Legal Disciplines at KUL NASU in the article Administrative and legal foundations for ensuring the security of Ukraine’s monetary and credit system He studied the administrative and legal principles of ensuring the security of Ukraine’s monetary and credit system as a key element of national economic security, and analyzed the concept, structure, and legal basis of this security.

Oleksandr Oleksiyovych Bryhinets, Doctor of Juridical Science, Professor, Professor of the Department of Constitutional, Administrative and Financial Law of Khmelnytskyi University of Management and Law named after Leonid Yuzkov, in the article «Features of modern legal regulation of the state’s currency security» analyzed the problem of the features of the nature and essence of legal support for increasing the level of Ukraine’s currency security in a special period.

Yulia Olehivna Pundor, PhD in Law, Associate Professor, Associate Professor of the Department of Law at Lutsk National Technical University and Viktoriya Vasylivna Anishchuk, PhD in Law, Associate Professor, Head of the Department of Law at Lutsk National Technical University in the article «Features of amendments to the Code of Ukraine on Administrative Offenses and other laws of Ukraine in connection with ratification» Council of Europe conventions on preventing violence against women and domestic violence and combating these phenomena They presented the concept of the Istanbul Convention and substantiated the necessity of implementing its provisions into national legislation, and analyzed key articles in the Code of Administrative Offenses and other laws that have undergone changes or were established for the first time.

Yaroslav Yaroslavovych Melnyk, Doctor of Legal Sciences, Senior Researcher of the Department for the Study of Law-Making Problems and the Adaptation of Ukrainian Legislation to EU Law of the Institute of Law-Making and Scientific-Legal Expertise of the National Academy of Sciences of Ukraine in the article ‘The Concept of Civil Procedure Development in the Context of European Integration’ studied the problems of the concept of civil procedure development in the conditions of European integration.

Ivan Ivanovych Vashchynets, Ph.D. in Law, Associate Professor, Associate Professor at KUL NASU, in the article The creditor’s right to enforce an obligation at the expense of the debtor under the civil legislation of Ukraine focused his attention on the creditor’s right to enforce a contractual obligation at the expense of the debtor with the possibility of subsequent compensation to the creditor for damages for such performance as a tool for improving the legal regulation of compensation for breach of contractual obligations.

Oksana Viktorivna Melnychenko, PhD in Law, Associate Professor of the Department of International Law and Sectoral Legal Sciences at KUL NASU in his research «Withdrawal of property from joint shared ownership» focused on the legal nature of joint marital property and outlined the main ways of its transformation through the withdrawal of property.

Yuriy Ladyslavovych Boshytskyi, Rector of KUL NASU, Prof., Honored Lawyer of Ukraine and Iryna Mykolaivna Sopilko, Doctor of Juridical Science, professor, Honored Lawyer of Ukraine, advisor to the rector of KUL NASU in the article “Ensuring the Right to Freedom of Expression: International Standards and Foreign Experience” Using analysis, systematic and analytical methods, they investigated the issues of international standards and foreign experience regarding the ensuring of the right to freedom of expression.

Hennadii Oleksandrovych Androshchuk, PhD, Associate Professor, Senior Researcher of the Research Institute of Intellectual Property of the National Academy of Legal Sciences of Ukraine presented research Intellectual Property in the Defense Industry: Status, Trends, Problems, and Solutions, in which he analyzed the economic and legal aspects of the role, condition, and development of IP in the defense industry: inventive activity, innovative activity, the efficiency of creation and use of IP objects in the system of the Ministry of Defense of Ukraine

Mykhailo Vitaliiovych Ponomarenko, lawyer, Doctor of Philosophy in Law, CEO of the Educational Online Platform ‘Pravozno’ in the article On the question of the necessity of implementing the law sui generis for software as a complex object of intellectual property in the legislation of Ukraine justified the need to implement in Ukraine a sui generis legal regime for the protection of software as a complex object of intellectual property.

Ivan Vasylovych Servetskyi, Doctor of Law, Associate Professor, Professor of the Department of Criminal Law and Procedure at KUL NASU and Markiyan Yuriyovych Lytvyn, a KUL NASU applicant, presented a comprehensive study of the concept of personal security as a multidimensional phenomenon, proposing a structural model of personal security in a scientific study ‘The Genesis of Personal Security: A Comprehensive Historical and Theoretical Analysis’.

Raisa Volodymyrivna Perelyhina, PhD in Law, Associate Professor, Associate Professor of the Department of Criminal Law and Procedure at KUL NASU and Yevhen Mykolayovych Semeniuk, a graduate student of the Open International University ‘Ukraine’ dedicated their research «Punishment for treason under the legislation of Ukraine and EU countries» coverage of provisions on liability for high treason under the criminal laws of Ukraine and EU countries. A comparative legal analysis of the elements of criminal offenses of the relevant articles of the Criminal Code of Ukraine with the criminal laws of the Baltic states was carried out.

Natalia Oleksandrivna Goldberg, PhD in Law, Associate Professor, Associate Professor of the Department of Criminal Law and Procedure of KUL NASU and Pavlo Vasylovych Yurchyshyn, PhD student of KUL NASU in the article «Powers of the prosecutor during the exercise of control over the commission of a crime» they revealed the interaction between the prosecutor, investigator, and head of the pre-trial investigation body during the initiation of operational and investigative activities, determined the exclusive powers of the prosecutor in making decisions regarding the control over the commission of a crime, and more.

Some aspects of the legal regulation of problems arising in a state of martial law during the organization of pre-trial investigation into the facts of committing military criminal offenses and crimes related to the violation of the laws and customs of war are examined in the article “Martial law as a motivational factor in the reform of criminal procedural legislation” Ivan Vasilyovych Kanfuy PhD in Law, Associate Professor of the Department of Criminal Law and Procedure, KUL NASU.

The guest of this episode was Vasyl Fedorovych Sirenko, Doctor of Law, Professor, Academician of the National Academy of Pedagogical Sciences of Ukraine, Corresponding Member of the National Academy of Sciences of Ukraine, Honored Figure of Science and Technology of Ukraine, People’s Deputy of the III and IV convocations of Parliament, non-partisan, who analyzed the main ideas and purpose of the concept of judiciary reform in Ukraine and proposed the main ideas of this concept, particularly in comparison with the Anglo-Saxon legal system in the study «Main ideas of the concept of judicial reform in Ukraine».

Significant scientific achievements are presented by young researchers who have prepared individual articles: I.V. Banny, PhD student at KUL NASU (‘Effectiveness of the principle of diversity of social life in the implementation of lawful restriction of freedom of association and freedom of activity of political parties’), O.V. Panasiuk, a student of the Yaroslav Mudryi National Law University (‘Features of Determining the Procurement Procedure During Public Procurement in Conditions of Martial Law’).

Koretsky of the National Academy of Sciences of Ukraine on the collection of scientific articles of postgraduate students and young scientists of KUL NASU Current Issues of Modern Legal Science and Practice in the Context of Martial Law» and the review Victor Ivanovich Little Shark, Doctor of Juridical Science, Professor, Leading Researcher of the V.M. Koretsky Institute of State and Law of NASU for work Chobit D. The Keys to Peace and War. Book One. The Imperial Madness of Muscovy / Dmytro Chobit – Kyiv: Ukrainian Priority – Ukrainian Culture. Brody: Prosvita, 2024. 320 pages, ill.; Ibid. The Keys to Peace and War. Book Two. A block of memorial articles (1 in Ukrainian and 16 in English with translation) presents sthoughts about the outstanding scientist Professor Arnold Reiner.

Y.L. Boshytskyi in the article “Arnold Rainer – an outstanding scientist, honorary doctor ‘Doctor Honoris Causa,’ and a great friend of the Kyiv University of Law of the National Academy of Sciences of Ukraine,” spoke about the history of cooperation between the university and the renowned scholar, emphasizing that sincere gratitude for Arnold Rainer’s devoted work in the field of law will forever remain in the hearts of the academic and teaching staff of KUL NASU. “May the memorial articles included in this issue of our legal scientific-theoretical quarterly ‘Journal of Kyiv University of Law’ become a good, bright remembrance of Arnold Rainer, an attempt to grasp the depth of his magnificent personality, a small manifestation of our great respect,” summarized Yuriy Ladislavovych.
